About the course

This two-day course is a specialist training for CAMHS clinicians, examining the legal framework for the care and treatment of children and young people with complex mental health needs.

It highlights the relevant key concepts, statutory provisions and safeguards for establishing the legal authority for detention and any proposed interventions.

This course also examines situations when children and young people can be treated informally; the relationship between children, young people, their parents/carers and mental health professionals in decision-making, and when the application of the MHA 1983 should be considered. The provisions of the MHA 1983 that are relevant to admission to hospital, care and treatment in hospital, discharge, aftercare and the community are explained.

The course is approved and accredited by the London Approvals Panel and is appropriate for those who are looking for an induction Approved Clinician course in preparation for AC status - or those consultants looking to renew their AC training. It is not appropriate for those who are only seeking a s12 training.

It has been developed by Camilla Parker, independent legal and policy consultant, Sarah Cannell, consultant social worker and Dr Dan Hayes, child psychiatrist from SLaM.

Learning objectives

The aims of the course are to help you understand:

1. The structure and key provisions of the Mental Health Act 1983 (MHA 1983) and the Code of Practice to the MHA 1983 (2015);

2. The interrelationship between the MHA 1983 and other areas of law, in particular the Children Act 1989, the Mental Capacity Act 2005 and the common law; and

3. The role and responsibilities of the Approved Clinician and the Approved Mental Health professional.

Very informative course

I thought the doctor involved in the teaching was relatively bullish at times. My wife (a Director at the CQC), who overheard him , felt the same. The rest of the Teaching Panel were warm, engaging and lovely to work with The Hand-outs were good and the chat room addendums to group discussions --- links to relevant topics/case Law updates --- was excellent I think that more time looking at the paperwork (visually/physically) especially The CTO related paperwork and SOADs would be helpful as a first sighting is often stressful for newly qualified S12/AC doctors I was impressed by the films shown and I think a separate feedback form for course attenders to fill in for the participants/family showing our appreciation and gratitude may be worth considering. The Panel's assurances that they were in close touch with the parents of one of the films YP (now very sadly, deceased) was much appreciated At £225 a day, having a 2hour session where you are left to read material seemed rather 'adventurous' Thank you to the course administrator (Mr JM) for coming to the rescue after some confusion when the paid for course, confirmed by email, failed to materialise as a confirmed place on the day
