Frequently asked questions

Is Mental Capacity Act training mandatory?

If you want to carry out certain functions under the Mental Capacity Act, you’ll have to complete mandatory training. Specifically, this has to be approved by the Department of Health. You can do these courses in person, or you can complete some online if you prefer.

What is the difference between DoLS and Mental Capacity Act?

The Deprivation of Liberty Safeguards (DoLS) is a part of the Mental Capacity Act. However, this is being replaced by the Liberty Protection Safeguards (LPS). The DoLS outlines the procedures in place to deprive someone of their liberty if they lack the capacity to consent. This is designed to keep them safe from harm. If you'd like to learn more about the LPS, book onto our Liberty Protection Safeguards training.
