About the course

This training course is developed by Camilla Parker, independent legal & policy consultant, Sarah Cannell, consultant social worker and Dr Dan Hayes, child psychiatrist from SLaM. The aims of the course are to allow participants to understand:
1. the structure and key provisions of the Mental Health Act 1983 (MHA 1983) and the Code of Practice to the MHA 1983 (2015);
2. the interrelationship between the MHA 1983 and other areas of law, in particular the Children Act 1989, the Mental Capacity Act 2005 and the common law; and
3. he role and responsibilities of the Approved Clinician and the Approved Mental Health professional.
The purpose of the course is to provide participants with an understanding of the legal framework for the care and treatment of children and young people with complex mental health needs, highlighting the relevant key concepts, statutory provisions and safeguards when ascertaining the legal authority for detention and proposed interventions. This includes understanding when children and young people can be treated informally, the relationship between children and young people, their parents/carers and mental health professionals in decision-making, and when the application of the MHA 1983 should be considered. The provisions of the MHA 1983 that are relevant to admission to hospital, care and treatment in hospital, discharge, aftercare and the community are explained.
This course is approved and accredited by the London approval panel and is appropriate for those who are looking for an induction Approved Clinician course in preparation for AC status or those consultants looking to renew/refresh their AC training. It is not appropriate for those who are only seeking a s12 training. The course is a specialist training for CAMHS clinicians
Target audience: Consultant Psychiatrists requiring Approved Clinician status or AC renewal (5 yrly renewal); CAMHS senior trainees (ST5 or 6) within 2 years of their CCT
